Terms and Conditions
All sales from Precision Web Tech to purchaser are subject to following terms and conditions.
Limited Product Warranties
Precision Web Tech warrants to the original purchaser that the purchased products will meet applicable specifications (as set forth in the product description), same to be free from defects in materials under normal use and service.
Precision Web Tech has a 30-day money back policy, and a one-year replacement warranty on components. Some components may carry a longer warranty as a result of the warranty provided by the manufacturer and the component manufacturer must process these warranties.
Precision Web Tech built systems carry a 30-day money back policy, and a three-year parts and labor warranty on complete systems only. After 30 days, Precision Web Tech will repair or replace components only, no credits will be issued. Service on a PWT system must be performed by a PWT service technician only. Service performed by any other individual, business or persons will void any warranty.
A new warranty period shall not be established for any replacement product, and such replaced products shall be warranted only for the remainder of the original warranty period. The warranties contained herein do not cover any damage due to accident, misuse, abuse, negligence, or acts of god which includes voltage surges and power failures. All warranty work is performed at Precision Web Tech Gerry, New York location and requires an RMA number (see product returns below).
IN NO EVENT WILL PRECISION WEB TECH BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTAL DAMAGES EVEN IF PRECISION WEB TECH HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE WARRANTIES CONTAINED HEREIN ARE IN LIEU OF ALL OTHER WARRANTIES EXPRESSED, IMPLIED OR STATUTORY, INCLUDING THE WARRANTIES OF MERCHANT ABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
EXCEPT FOR DAMAGE DUE TO PWT'S NEGLIGENCE OR WILLFUL MISCONDUCT, THE LIMITATION OF PWT’S TOTAL LIABILITY HEREUNDER SHALL NOT EXCEED THE TOTAL AMOUND PAID TO PWT UNDER THIS INVOICE.
This Limited Warranty gives specific legal rights, one may also have other rights, which vary from state to state. Some states do not allow for the exclusion of consequential damages or the limitations on the duration of implied warranties accordingly, the exclusion and limitation contained herein may not be applicable in some circumstances.
Sales on Special Order merchandise are final – no refunds will be granted.
ANY WARRANTY FOR SOFTWARE INCLUDED IN OR RELATED TO THE PRODUCTS PURCHASED HEREUNDER HAS BEEN SUPPLIED BY THE MANUFACTURER. PWT MAKES NO REPRESENTATION FOR WARRANTY, EITHER EXPRESS OR IMPLIED INCLUDING THE WARRANTY OF MERCHANTABILITY AND WARRANTY OFFERS FOR A PARTICULAR PURPOSE, WITH RESPECT THERETO AND SHALL HAVE NO LIABILITY IN CONNECTION THEREWITH. Products sold by PWT are not designed for use in life support equipment where malfunction of such product can reasonably expected to result in personal injury. Purchasers using or selling such product for use in life support equipment do so at their own risk and agree to fully indemnify
PWT or the manufacturer of such products for any damages resulting from such use or sale.
If technical advice is offered or given in connection with the use of any products, it will be as an accommodation to purchaser and without charge, and PWT shall have no responsibilities or liabilities whatsoever for the content or use of such advice.
Terms Of Payment
PWT accepts master card, visa, (charges may apply). Personal and company checks and C.O.D. orders are subject to approval prior to shipping. If a check is returned for insufficient funds, or any other reason, drawer will be charged $25.00 to cover bank charges and administration fees. Purchaser agrees to pay all taxes, however designated levied or based, on the sales price war payable by PWT in retrospect thereto.
Default Payments will result in void of warranty until payment is received.
Shipping
UPS is PWT’S preferred shipper and all packages in the continental United States are shipped UPS unless otherwise specified. Shipping charges are prepaid to the carrier and charged on purchasers invoice. PWT may ship partial orders unless specified otherwise at the time of the order. Claims with missing items must be made within three days of delivery of your order. It’s a purchaser’s responsibility to report to the shipper and the packages that arrive damaged, as the shipper must inspect the carton and issue a claim number. PWT shall not be liable for any failure of or in the performance of orders, or in the delivery of shipment of products, or for any damages suffered by purchase or by reason of such failures or delay. PWT reserves the right into its sole discretion to allocate among purchasers or potential purchasers, to defer or delay the shipment of, any product which is in short supply.
Title
Title to the products sold here under will be deemed to pass only to purchaser upon full, complete and final payment of the products. In the event of purchasers default in payment for the products, purchaser accepts responsibility for all costs and expenses incurred by PWT in collection of any sums owing by purchaser and PWT shall not be obligated to make further deliveries to purchaser. Such costs and expenses shall include, but not limited to, reasonable attorneys fees, collection fees and court costs.
Product Returns
A return merchandise authorization (RMA) number must be issued before any product may be returned to PWT. To obtain an RMA number, please call PWT of with the original invoice number and description of the problem. An RMA number will be issued where appropriate. That number must be displayed clearly on the outside of the shipping package. RMA numbers are good for 30 days from the date of an issue and RMA products must be received freight pre-paid. PWT shall not accept COD RMA returns. Products being returned for credit must include complete packaging, manuals, cables, etc. If any of these items are missing or damaged, credit cannot be issued.
Pricing
Due to an ever-changing world of technology PWT reserves the right to change prices without notice. PWT will not be responsible for pricing, photographical, or typographical errors in publications distributed or posted on web site.
Governing Law and Forum
Any dispute regarding the interpretations the validity hereof shall be governed by the laws of the state of New York of the regard to its conflicts of the law. PWT Computer Services and purchaser hereby agreed that any dispute relating to the terms and conditions of sale furnished here under shall be subject to the jurisdiction of the courts of New York.
